Terms & Conditions for Internet Access Services
This represents the mutual complete understanding between North Rock Communications Ltd. and you and supersedes any other written or oral agreement. Upon notice published on-line, North Rock Communications may change these terms and conditions, and/or change the prices charged for these services, and/or discontinue or change the services offered.
Account and Agreement Term
This agreement shall remain in effect until you terminate your account or North Rock Communications cancels your account. North Rock Communications may occasionally require new registration and account information to continue this service. In addition, you shall notify North Rock Communications in writing or by e-mail of any changes in the account information, such as address or phone number. North Rock Communications reserves the right to change the terms and conditions of this agreement by notifying you via e-mail at least 15 days in advance of the effective date of the change. If you do not agree to the terms and conditions, you may cancel this agreement at any time by giving North Rock Communications proper written notice in accordance with the terms and conditions stated herein.
North Rock Communications reserves the right to terminate an account at any time for violation of this agreement.
Billing/Terms/Termination
North Rock Communications will bill you acc rding the method of payment you choose from our payment options, for monthly subscription and connection fees as set forth in North Rock Communications' current rate schedule. This schedule may be modified by North Rock Communications upon 15 days notice by e-mail to you.
The North Rock Communications accounting cycle begins on the day that your account is enabled. The North Rock Communications accounting period is one month. You must notify North Rock Communications at least 15 working days before the start of the next accounting cycle if you wish to change type of account or method of payment.
Charges for service are payable in advance of receiving services. There is a $20.00 service charge for each returned cheque or decline credit card charge. Outstanding accounts are subject to a $5 late payment fee after 60 days. Delinquent accounts (accounts in 90 days) will be placed on "accounting hold" and may not be used until the account is brought up to date, including any returned check or declined credit card service charges. All expenses incurred by North Rock Communications in attempt to recover overdue amounts will be charged to the delinquent account. Accounts may be reinstated upon payment of any outstanding charges and will be subject to a $10 fee administration.
Termination requests for North Rock Communications accounts must be received in writing via e-mail, fax, or postal service at North Rock Communications' main office. Accounts will be terminated at the end of the accounting cycle in which the termination notice was received.
You are responsible for all fees up to the date of termination of the service, except where North Rock Communications is unable to provide services under this agreement through its own negligence.
Provision of Services
North Rock Communications will provide services on its host computing systems to individual customers in exchange for payment of fees and compliance with the terms and conditions of this document. North Rock Communications services are defined as the use by Customer of computing, telecommunications, software, and information services provided by North Rock Communications. These services also include the provision of access to computing, telecommunications, software, and information services provided by others via the world-wide computer network known as the Internet. There are no facilities for secure private communications or data storage provided by North Rock Communications.
Security of Accounts
North Rock Communications Dial-up accounts are for individual users and you therefore agree not to share the password or use of the account with others, including but not limited to other family members or business associates. You agree to maintain a secure password to the account.
Abuse of Internet Services
You agree to use the services provided by North Rock Communications as permitted by applicable local laws.
You agree to refrain from mass posting of the same message to many inappropriate Usenet newsgroups (spamming). You agree to refrain from mass, unsolicited e-mailings. You agree to post advertisements only where appropriate, for instance in biz, for.sale, and other venues that specifically encourage or allow advertising. You agree to respect the conventions of the newsgroups, lists and networks to which the you are posting, including rules more restrictive than but not limited to the above. You agree to indemnify and hold North Rock Communications harmless against losses resulting from your use of the service that damages you or any third party.
Any use of North Rock Communications system resources that disrupts the normal use of the system for other North Rock Communications customers is considered to be an abuse of system resources and is grounds for administrative intervention. Some examples of system abuse include spawning dozens of processes, consuming excessive amounts of memory or CPU for long periods of time, and staying attached to modems while not really "active" on the line.
Offensive or Adult Materials
North Rock Communications exercises no control over the content of materials accessed through North Rock Communications. Some materials may be offensive or adult in nature. If you are under 18 years of age, you need to have your parent or guardian send a letter of consent to North Rock Communications authorizing your use of North Rock Communications.
Content
North Rock Communications has the right but not the responsibility to examine and/or remove any online materials, including news, email, and user files.
Warranties
North Rock Communications makes no warranties of any kind, whether expressed or implied, for its services, including but not limited to virus scanning and spam filtering services, and specifically disclaims any implied warranties of merchantability or fitness for any particular purpose. North Rock Communications will not be responsible for any losses or damages resulting from delays, nondeliveries, misdeliveries, service interruption, or your errors or omissions. North Rock Communications will not under any circumstances be responsible for consequential damages.
Jurisdiction
The validity, construction and performance of this agreement shall be governed by the laws of the islands of Bermuda.
Severability
If any provision of this agreement is held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this agreement will remain in full force and effect.
Effective date
This agreement shall become effective when your access to North Rock Communications is enabled.
Your use of North Rock Communications services constitutes your acceptance of these terms and conditions.
